Terms & Conditions
1. Interpretation
1.1 The following definitions and rules of interpretation apply:
- “AquaTour” means AquaTour Ltd, Conwy, North Wales.
- “Conditions” means these terms and conditions for the provision of services.
- “Contract” means the contract between AquaTour and the Customer for the provision of services.
- “Customer” means any individual, company, or organisation (including employees, agents or subcontractors) that places an order or purchases a service from AquaTour.
- “Service” means any trip, product, service, or facility offered by AquaTour to the Customer.
1.2 References to “we, us, our” mean AquaTour (including our employees, skippers, and
crew).
1.3 References to “you, your” mean the Customer.
1.4 Headings are for convenience only and shall not affect interpretation.
1.5 References to “writing” include email.
2. Application of Terms
2.1 These Conditions are the only terms on which AquaTour contracts with Customers. They
override any other terms proposed by the Customer.
2.2 A booking is only accepted once confirmed in writing by AquaTour or once the Service has commenced.
3. Booking
3.1 Bookings can be made via our website, email, or phone. No provisional bookings will be
held without payment.
3.2 Customers must read the trip description carefully before booking.
3.3 Full payment is required at the time of booking for individual seats.
3.4 Group, private charter, or corporate bookings require a 50% deposit at the time of booking, with the balance payable before departure.
4. Payment
4.1 Individual trips may be VAT exempt. Commercial or corporate bookings are subject to VAT.
4.2 Payment must be received in full before a trip commences.
4.3 AquaTour reserves the right to cancel any booking without refund if payment terms are not met.
- Amendments by Customer
5.1 Bookings may be transferred to another person provided at least 7 days’ notice is given and the substitute meets the safety/medical requirements.
5.2 Customers may reschedule up to 7 days before departure, subject to availability.
5.3 If rescheduling is not possible, a voucher valid for 12 months will be issued.
6. Cancellations
6.1 By the Customer
- More than 7 days’ notice: Refund less 10% admin fee.
- Within 7 days: No cash refund. A 12-month voucher will be issued.
- Within 24 hours: All fees are forfeited.
6.1.4 Customers are advised to arrange their own travel insurance.
6.2 By AquaTour
We reserve the right to cancel or amend trips at any time due to weather, sea conditions, safety concerns, mechanical issues, or unforeseen circumstances. Options offered will be:
- Transfer to an alternative trip (same or different date).
- A voucher valid for 12 months.
- A refund (minus a 10% booking fee).
7. Safety
7.1 Safety is our highest priority. Customers must understand that RIB rides and fast-moving
water-based activities carry inherent risks.
7.2 AquaTour provides:
- Fully qualified skippers and crew.
- Approved lifejackets and safety equipment.
- Vessels maintained to MCA coding standards.
- Pre-trip safety briefing.
7.3 Customers must comply with all instructions given by crew. Failure to do so may result in
removal without refund.
7.4 AquaTour reserves the right to cancel or modify trips if conditions present unmanageable
risks.
8. Health & Medical Conditions
8.1 Participation requires a reasonable level of fitness. Customers are responsible for ensuring the activity is within their ability.
8.2 You must consult us if you have any of the following conditions.
- Are pregnant.
- Have back, neck, bone, or joint conditions aggravated by motion.
- Have heart conditions, epilepsy, or similar medical issues that may be triggered by
vibration or sudden movement.
Are under the influence of alcohol or drugs.
8.3 Customers must declare all relevant medical conditions when booking. Failure to disclose may result in refusal to board without refund.
8.4 AquaTour reserves the right to refuse participation if a condition is deemed unsafe for the
individual or others.
8.5 Children under 16 must be accompanied by a responsible adult. Minimum age restrictions may apply depending on trip type.
8.6 Seasickness: Customers prone to motion sickness are advised to take precautions before travelling (no refunds will be given if you cannot complete the trip due to seasickness)
9. Complaints
Complaints must be raised immediately with the skipper or AquaTour staff so they can be
resolved. If not resolved, the Customer may escalate in writing to management within 14 days of the trip.
10. Behaviour
Customers must respect crew instructions and other passengers. AquaTour may terminate the trip without refund if anyone behaves in a way likely to cause danger, distress, or damage. Customers will be liable for any damage caused.
11. Liability
11.1 AquaTour does not exclude liability for death or personal injury caused by negligence.
11.2 Customers’ belongings remain their responsibility at all times. AquaTour accepts no liability
for loss or damage unless caused by our negligence.
11.3 AquaTour shall not be liable for indirect or consequential losses, including loss of enjoyment, profit, or travel costs.
11.4 Customers are strongly advised to arrange travel and medical insurance.
12. Photography & Media
Photos and videos may be taken during trips for promotional use. Customers who do not wish to be included must inform AquaTour staff before departure.
13. Force Majeure
AquaTour will not be liable for delays or cancellations caused by circumstances beyond our
reasonable control (e.g., weather, strikes, government restrictions, mechanical breakdowns,
natural disasters).
14. Law & Jurisdiction
These conditions are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Booking Disclaimer
By making a booking with AquaTour you confirm that:
- You and your group are free of contagious illnesses (including Covid-19 symptoms).
- You are physically fit to take part in a high-speed RIB activity.
- You have disclosed all medical conditions.
- You agree to wear safety equipment provided.
- You accept that AquaTour is not liable for personal property
